Arbitration Agreement in India- An Overview

Abstract


The arbitration is a term of Alternate Dispute Resolution where by who litigating parties desire their dispute to settled outside the court. An arbitration agreement is a pre. Condition for commencement of arbitral proceedings an arbitration agreement may be a clause in a contract   or a separate agreement to arbitrate all or certain disputes which have arisen or may arise in respect of a defined legal relationship, whether contractual or not. Arbitration agreements should be strictly construed in the sense that clear lan­guage should be introduced into the contract which is to have the effect of ousting the jurisdiction of the court and compelling the parties to have recourse to arbitration for the decision of Parties.
